NEEED HELP! I am in a situation were i have been caught with 15 baby marijuana plants and i need help!!?

I was caught the other day by the police with 15 baby marijuana plants not even close to being done, and i am only 17 years old. Yesterday i was told by some people if they werent in the budding process or werent even close to it that they can be claimed as hemp. Is this true??Because if so when i go to court i will be able to use this as another defence, If anyone knows if this is true then please let me know!!! Just to let people know that hemp is marijuana plants that are males and dont actually grow weed on them. THANKS!
